  • Ohio CAT marketing e-mails will not be deceptive in their use of email addresses, names, domain names or subject lines to mislead the recipients. Ohio Cat will always strive to be truthful and honest in marketing e-mails.
  • All Ohio CAT marketing e-mails will be clear and signal that the e-mail communication is a marketing e-mail and the message will be identified as such.
  • No Ohio CAT marketing e-mails will contain adult content or explicit imagery.
  • All marketing e-mails will include a physical street address
  • All marketing e-mails will provide customers with a conspicuous and straightforward way to unsubscribe from the email list. Ohio CAT will follow all unsubscribe requests received as soon as possible, sometimes instantly, but at least within 10 days. Upon unsubscribing, you may receive a final confirmation notice that you have been removed from the list.
  • Removal from our marketing list will still allow Ohio CAT to communicate with you for non-marketing messages. These are only as “transactional messaging” where necessary to communicate, in the normal course of doing business with you.
  • Opt-out/Unsubscribe data will be contained within the e-mail list data and will ensure that unsubscribed customers will not get further marketing e-mails from list-based marketing communications.

About Children

Our website, services, and products are not designed for, marketed towards, or intended for children. If we are made aware that we have collected personal information from a child under the age of 13 years in a manner inconsistent with the Children’s Online Privacy Protection Act, we will delete such information as soon as possible.

Ohio CAT, Caterpillar Inc., and their affiliated persons and companies are currently handling the processing of personal information and intend to use and share this information only to process customer orders and for our operational purposes, including to improve or market our products and services. The personal information may be transferred to and processed in various countries, including countries like the U.S., which have chosen not to adopt comprehensive federal codes for handling personal data.
We will not sell or rent your information to any third party. The data collected on this site is for the explicit use of Ohio CAT, Caterpillar Inc. and affiliated persons and companies. We comply with Caterpillar, Inc. and Caterpillar Financial privacy policies. However, we will disclose personal information where such a disclosure is necessary to comply with the law, to protect the safety of our users or others, or for other purposes relevant to our company policies.

Caterpillar Inc. and its subsidiaries and affiliated entities (collectively, “Caterpillar”) and Ohio Cat each collect, use, retain, disclose, and otherwise process personal information for, among other purposes, providing information about warranty, customer marketing and promotional material about Caterpillar and/or Dealer products or services. Consumer Requests

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

Making a verifiable consumer request does not require you to create an account with us.

When you submit a verifiable consumer request, we will take steps to verify your request ‎by email or telephone call. In some cases, we may request additional information to verify ‎your request or where necessary to process your request. If we are unable to adequately verify a ‎request, we will notify the requestor. Authorized agents will be required to provide proof of their ‎authorization, and we may also require that the relevant consumer directly verify their identity and ‎the authority of the authorized agent.‎

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

 

Right to Know and Access Your Information

You have the right to request that we disclose to you certain descriptions and categories of the personal information we collect, use, disclose, share, or sell about you. For example, you may request the following through a consumer request:

  • (1) The categories of personal information we have collected about you.
  • (2) The categories of sources from which personal information is collected.‎
  • (3) The business or commercial purpose for collecting, selling, or sharing personal information.
  • (4) The categories of third parties to whom we disclose the personal information.‎

Right to Request Deletion

You have the right to request that we delete your personal information. See above for additional details about how to submit a consumer request.

You should be aware, however, that state laws, including in California, allow us to retain your personal information under certain conditions, even if you have asked us to delete it, such as when retaining your personal information is necessary for us to complete a transaction with you or provide you with a good or service you have requested. We will notify you of any denial of your deletion request and the reason for such denial.

Right to Limit the Use of Your Sensitive Personal Information

We use and disclose sensitive personal information we collect about you. You or your authorized representative may limit our uses and disclosures of your sensitive personal information by making a request.

To submit a request under the Right to Limit, please provide the information necessary to identify the consumer to whom the request should be applied and reasonable identifying information that you are authorized to make the request and submit an email requesting your “Right to Limit” to marketing@ohiocat.com or by phone at (800) 837-6200 (toll free).

Once you make a request to limit our use and disclose of your sensitive personal information, we will wait at least twelve (12) months before asking you again. However, you may change your mind and opt back in to personal information sharing or at any time by submitting an email requesting your “Revoke Right to Limit” to marketing@ohiocat.com or by phone at (800) 837-6200 (toll free).

 

Right to Opt-Out of the Sharing or Sale of Personal Information

We do not share or sell personal information subject to the disclosures in this policy.

 

Right to Non-Discrimination for Exercise of Consumer Privacy Rights

We will not discriminate against you because you have chosen to exercise any of your privacy rights provided by the laws of your state of residence.
